Justice Glenn Joyal has quashed a court order that forced CBC to give up field tapes of coverage of an RCMP shooting in Manitoba, according to a CBC.ca report.
The police had asked CBC and CTV to pass on the tapes that included recordings from a press conference that the RCMP was aware of, but did not attend.
Justice Joyal said:
“…it would appear that by not attending the press conference, the RCMP
were implicitly choosing to ‘deputize’ the journalists who they no
doubt expected would be attending. If there was evidence to be
gathered, the RCMP, by their choice, seemed content to let the media
gather it.”
